Why does, a landlord needs a Lease Agreement? How does it safeguard his property rights?

The following details would explain the need of the Lease Agreement and why they are necessary:

An Individual may own a property and might want to lease out certain part or full property to another person on a lease. In this case the individual owning the property is known as landlord and the person who is taking the property on lease is termed as tenant.

In order to protect from various legal tangles, to safeguard his interests and defining the rights of the tenant, it becomes necessary to draw the Lease Agreement Form, to be signed by the landlord and the tenant. • The lease Agreement should be written in professional way, which can be accepted in court at the time of need.
• The condition of the property should be mentioned explicitly.
• Familiarize with the specific state’s Right of Entry provisions.
• Any reservation regarding the pets kept by the tenant.
• Security deposit Refund procedure and conditions.
• Mention clearly in the lease agreement about rental amount, rent due date, security deposit and other expenses to be bourn by the tenant in course of his tenancy.
• Duration of Lease period and renewal provisions.
• Write about the course of legal action that would be taken against the tenant, in case of default in rent payment or any other unwanted action of the tenant.
• Tenants specific maintenance and utilities responsibilities.
• Any common prohibition applicable to the tenant during the tenancy period.
• Eviction Criteria
• Conditions for revision and termination of the contract by both concerned parties.

The landlord should take the assistance of an Attorney or any professional help, during formulation of the Lease agreement, because certain legal words may be interpreted differently in court of law, which may be problematic to the landlord, if any time, he is compelled to fight court battle with the tenant.
