You may have been transferred to newer location by your office, compelling you to vacate the existing Leased apartment. But, if you think, you can just quit your apartment, it is not possible as you have already signed a Lease Agreement with the landlord and the contract contains provisions for the lease Termination. If you happen to step away from the clause mentioned in the Agreement then, you are violating the terms in the Agreement and may draw penalties for the breach of the contract.
There are various reasons, why a tenant wants to terminate the Lease and they includes, shifting to another city, changing the residence for better living, inhospitable condition of the leased Apartment, lack of proper care and maintenance of the leased property by the landlord or expiry of the lease period.
It is also to be noted that, if any condition on the lease is not fulfilled by the landlord then, the tenant has right to terminate the Lease as per Agreement but, reasons other than mentioned in the Contract may be termed as breach of Contract, by the tenant and may draw penalties. These reasons make it necessary that, the tenant should read Lease Agreement carefully, before opting to terminate the Lease otherwise he may be liable for suitable legal action by the landlord.
It is also necessary that, before terminating the Lease, the tenant should inform the Landlord in advance by sending him Notice of Termination of Lease, which can offer the landlord sufficient time to make alternate arrangement for the leased property. Even, state Tenancy Law stipulates prior information either by the landlord or tenant before ending or terminating the lease.
