You have taken a lease to a residential property but now suddenly, your company transferred you to another city, though your lease Agreement is yet to expire. What options do you have now to save money on paying to leaser? You can simply look for the suitable tenant, who can take lease of your apartment, till lease date is expired.
But it is also to be noted that sub leasing a residential place is not possible unless, permitted by the landowner. The Home Lease Agreement also contains provisions, which forbids the tenant from sub leasing the leased residential property to the third persons. If you sub lease the place without informing the landlord or without his permission then, such actions may be concurred as breach of contract and landlord may give you notice to vacate the leased property.
But if landlord agrees for subleasing then, you will have to enter into Agreement with the sub tenant. Such contracts are legally known as Residential Sub Lease Agreement and are legally valid and binding ob both tenant and sub tenant.
The main reason for entering into such Contracts is due to the clauses and provisions, which are recorded in the Agreement. The important clauses in the Contracts are as follows:
By signing the Agreement, the tenant and sub tenant both protects their right and function within their own parameter by executing their duties and responsibilities effectively.
RESIDENTIAL SUBLEASE AGREEMENT
This Sublease Agreement is made between ____________________, the "Sublessor," and _______________________, the "Sublessee," together referred to as the "Parties."
The Parties agree that the Sublessee will lease from the Sublessor a portion of the Sublessor’s interest in the premises located at ______________________________,City on the following
Terms:Lease Term. The lease term is for a period of ______________, beginning on______________ and ending on ________________
Rent.Sublessee will pay a total monthly rent of $ ___________. Rent shall be payable on the first day of each month directly to the Sublessor at the following address___________________________
Master Lease. In addition to the terms and conditions of this Sublease Agreement, the Sublessee agrees to be bound by all the terms and conditions of the Master Lease between Sublessor and the Landlord, _____________.A copy of the Master Lease is attached and incorporated into this Sublease
Agreement by reference.Other representations not included here or in the MasterLease, are not binding on the Parties
Security Deposit. Sublessee will pay $ ___________ to Sublessor as a security deposit. At the end of the lease term, only amounts allowed by law may be retained from the security deposit, and the remainder, if any, shall be returned to Sublessee in accordance with ____________ state law. The security deposit may not be used as last month’s rent.
Inventory Checklist.At the time Sublessee takes possession of the premises, the Sublessor will provide him or her with an inventory checklist. Sublessee will complete and return the checklist to the Sublessor within 7 days.
Utility and Telephone Charges.The Sublessee will pay _% of all utility charges (water, gas, electric, cable).Sublessee will pay all telephone charges for calls they, themselves, or their guests, made, and Sublessee
pay ____% of the monthly telephone service charges.
Condition of the Apartment.Sublessee acknowledges that he or she has examined the premises and that it is in satisfactory condition. Upon the termination of this Sublease Agreement for any cause whatsoever, Sublessee will restore the premises to its original satisfactorycondition, except for reasonable wear and tear. Sublessee is responsible for the repair of any damage resulting from his or her act or neglect of that of their guests.
Holdover. Sublessee will promptly vacate the premises at the end of the lease term. Holding over is not allowed.
Subleasing and Assignment. Sublessee may not sublease or assign their interest in the premises to another without Sublessor’s written consent.
Parental Consent and Guarantee. If the Sublessee is under eighteen (18) years of age, his or her legal guardian or parent, by their signature, guarantees and agrees to perform all the terms and conditions of this Sublease Agreement.This Agreement is Complete and Binding. All preliminary negotiations between the Parties are merged into, and superseded by, the terms of this Sublease Agreement. This Sublease Agreement becomes enforceable when signed by both Parties. Anymodification to this Sublease Agreement must be in writing, signed by both Parties.

Landlord’s Consent. This Sublease Agreement is not binding on either Party unless the Landlord givesconsent by signing below. The Master Lease requires this approval.
Mediation Agreement.If a dispute arises out of or relates to this contract, or its breach, and if the dispute cannot be settled through negotiation, the Parties agree first to try in good faith to settle the dispute by mediation under the Mediation Rules of the American Arbitration Association before resorting to some other dispute resolution procedure.
